Innhold: | Abstract: It follows from the Norwegian Procurement Act section 5 that contracting authorities shall take appropriate measures to ensure that public contracts are performed in accordance with horizontal policies such as social rights and labour rights. The article analyses the scope for contracting authorities’ possibility to set out such requirements pursuant to the public procurement rules, with particular emphasis on contractual requirements. The article also analyses three typical examples of such contract provisions, i.e. requirements for the use of apprentices, requirements for the use of permanent employees and the use of subcontractors. Pursuant to the applicable sources of law, the contracting authorities have a broad discretion to set out contract provisions regarding social and labour rights. Such provisions must however be linked to the subject matter of the contract. This implies that the provisions must relate to the work undertaken for the specific contract. The provisions cannot relate to the supplier’s general business operation. The requirements must also comply with the fundamental principles set out in the Norwegian Procurement Act section 4.
