As a general rule, these are anchored in the municipality’s standardized subscription conditions and VA norm. It is clear from these conditions that the requirements have been set by the municipality in its capacity as owner.
At issue is whether such provisions can actually be anchored in the municipality’s ownership, i.e., in the municipality’s private autonomy, with the associated consequence that only private law rules can regulate the relationship between a municipality and a private party. The traditional answer to this has been yes. With this article, I want to question this starting point. With reference to the Supreme Court’s decision in HR-2021-2510-A, there are strong arguments that municipalities’ subscription conditions cannot be anchored in their private autonomy (ownership).
The nature, purpose and social area of the terms support this direction.
