Innhold: | International commercial contracts are governed by a plurality of sources, often referred to as "international commercial law". This is, however, no unitary body of law but consists of rules based on a variety of sources such as international conventions, generally recognised principles, trade practices, soft codifications and, not the least, domestic laws. This book examines the interaction of these sources with each other - not the least in the light of international contract practice, which aspires at avoiding some of these sources by drafting contracts that aim at being self-sufficient. Testing the contract's ability to be self-sufficient, the book examines matters in the fields of comparative contract law, transnational law, private international law and international arbitration. All these elements contribute to the proper understanding of international commercial law. |
