Innhold:Et grunnleggende prinsipp i norsk forvaltning er at den skal være kunnskapsbasert. Prinsippet innebærer at kunnskap skal være et viktig grunnlag når forvaltningsorganer tar myndighetsbeslutninger. Denne kunnskapen omfatter blant annet kunnskap om hvilke utfordringer vi har som samfunn, omfanget av utfordringene og virkningene av tiltakene som brukes. Prinsippet er basert på en forutsetning om at kunnskap bidrar til bedre håndtering av de samfunnsutfordringene vi står overfor, enn grunnløse antakelser, personlige synspunkter eller mer ideologiske overbevisninger.

Abstract
Knowledge of landslides, floods and storm water is significant to the risk management of these forms of natural hazards. The principle of knowledge-based management is of importance for NVE is performing its tasks regarding landslides, floods and stormwater as well as and for the municipalities’ tasks as planning and building authorities. Regardless of the principle that administration should be knowledge-based, there are a number of legal challenges for NVE as a sector authority, professional authority and competence body in the work with landslides, floods and storm water. The Article analyzes legal challenges related to the distribution of responsibility NVE as the state’s professional directorate and the municipalities. This becomes particularly clear when NVE’s professional advice is used, but not given decisive weight in the political considerations made by the municipalities as planning authorities. Furthermore, the Article analyzes legal challenges regarding the responsibility of NVE in contributing to the acquisition of knowledge. This applies, for example, to the question of whether NVE should use objections as a remedy. In addition, the Article analyzes legal challenges to the dissemination of knowledge about landslides, floods and stormwater. This is due, among other things, to the fact that it must be communicated that the information is of satisfactory quality and that there are uncertainties associated with the information.
