Innhold:On 17th of October the Court Justice of the European Union («CJEU») handed down its decision in the case C-159/23 Sony Computer Entertainment Europe Ltd v. Datel Design and Development Ltd and Others («Case»). The Case concerned the scope of copyright protection of computer programs and is thus somewhat of a rare treat as these decisions are far and few between. In summary, the CJEU did not recognise that a computer program's content of a variable gained copyright protection as a part of a computer program and thus changing it did not amount to prohibited alteration of protected material. While the outcome is fairly simple, its implications are not necessarily that. To understand the decision and its reasoning there needs to be a short evaluation of the underlying legal principles and facts for the Case.
