I utredningen om ny forvaltningslov (NOU 2019: 5) foreslår flertallet å ikke videreføre sakskostnadsregelen i någjeldende forvaltningslov § 36. På bakgrunn av erfaringer fra retthjelpsarbeid og fra advokatkontoret søker denne artikkelen å belyse hvorvidt en slik endring er ønskelig.

In its draft act, the Law Commission on the Public Administration Act has attempted to construct the provisions regarding the duty of confidentiality in light of the right to access to official documents under Article 10 of the European Convention on Human Rights (ECHR). However, the Commission’s examination of Article 10 is rather brief, and the proposed Article 36 (2) litra d is inadequate. This article argues that there is a need for more thorough assessments in the follow-up of the draft act and the remaining legislative process. It also provides an overview of recent case law in the field.
