De siste årene er det forsket mye på dispensasjonspraksis, hvor ivaretakelsen av naturmangfoldet har fått begrenset oppmerksomhet. Dispensasjonspraksisen har betydning for hvordan kommunene ivaretar sårbare naturområder. I 2023 ble det utført en dokumentanalyse av 464 dispensasjonsvedtak i perioden 2020–2021 i kommunene Råde, Moss, Hol og Hemsedal. Hensikten var å undersøke kommunenes dispensasjonspraksis. Denne artikkelen belyser hvordan kommunene i dispensasjonsbehandlingen ivaretar de sårbare naturområdene. Det redegjøres også for hvordan kommunene begrunner vurderingene av prinsippene i naturmangfoldloven §§ 8–12. Dispensasjonsbestemmelsen er en unntaksbestemmelse, og til tross for at lovgivers intensjon er at utvikling skal skje gjennom plan, innvilger landets kommuner et stort antall dispensasjoner.

Abstract
In recent years, a lot of research has been done on dispensation practices, where the protection of natural diversity has received limited attention. The practice of dispensation has an impact on how the municipalities safeguard vulnerable natural areas. In 2023, a document analysis was performed of 464 dispensation decisions in the period 2020–2021 in the municipalities of Råde, Moss, Hol and Hemsedal. The purpose was to investigate the municipalities’ dispensation practices. This article sheds light on how the municipalities in the dispensation process safeguard the vulnerable natural areas. It also explains how the municipalities justify their assessments of the principles in the Nature Diversity Act §§ 8-12. The dispensation provision is an exception, and despite the fact that the legislator’s intention is for development to take place through planning, the country’s municipalities grant a large number of dispensation.
