Nitrogenforurensning er en av årsakene til at Oslofjorden er i svært dårlig miljømessig forfatning. Økte utslipp er i strid med regjeringens overordnede strategi for en rik og ren Oslofjord, så på hvilket grunnlag ble tillatelsen gitt? For å tillate utslippet måtte all EØS-rettslig og norsk internrettslig lovgivning for beskyttelse av miljøet settes til side gjennom unntak som eksisterte og unntak som ble vedtatt for å gjøre utslippet lovlig. Artikkelen redegjør for regelverket som forbyr utslipp, og unntaksbestemmelsene, og det stilles kritiske spørsmål til prosessen og konsekvensen av å fravike handlingsplanen.
In February 2024, the Chemring Nobel munitions factory received permission to increase its nitrogen emissions to the Oslofjord fivefold. Nitrogen pollution is one of the reasons why the Oslofjord is in very poor environmental condition. Increased emissions are contrary to the Government’s overall strategy for a rich and clean Oslofjord, so on what basis was the permit granted? In order to permit the discharge, all EEA and Norwegian domestic legislation for the protection of the environment had to be set aside through exemptions that partly already existed and partly exceptions that were adopted to make the discharge legal. The article describes the regulations that prohibit emissions and the exemption provisions, and critical questions are asked about the process and the consequences of deviating from the Government’s strategic plan for the fjord.
